Welcome to Tovly! These Terms of Service ("Terms") govern your use of the Tovly mobile application (the "App") operated by Tovly ("we," "our," or "us").

By downloading, accessing, or using Tovly, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Tovly is a personal wellness app that helps you analyze food and product ingredients based on your health profile, dietary restrictions, and wellness goals. The App provides:

  • Barcode scanning and manual product entry
  • AI-powered ingredient analysis personalized to your profile
  • Health compatibility scores and recommendations
  • Scan history tracking

2. Account Registration

To use Tovly, you must:

  • Be at least 13 years of age
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activity under your account.

3. Subscriptions and Payments

Free Tier

  • Limited to 5 scans per day
  • Limited scan history access

Premium Subscription

  • Unlimited scans
  • Full history access
  • Additional features as introduced

Payment Terms:

  • Subscriptions are billed through Apple's App Store
  • Prices are displayed in the App before purchase
  • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
  • Manage or cancel subscriptions in your Apple ID account settings

Refunds: Refund requests are handled by Apple in accordance with their refund policies.

4. Acceptable Use

You agree NOT to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or hack the App
  • Interfere with or disrupt the App's functionality
  • Create multiple accounts to circumvent usage limits
  • Use automated systems (bots, scrapers) to access the App
  • Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Health Disclaimer

TOVLY IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

  • The App provides general wellness information only
  • Analysis and recommendations are for informational purposes and should not replace professional medical advice
  • Always consult a qualified healthcare provider before making dietary changes, especially if you have medical conditions
  • We do not diagnose, treat, cure, or prevent any disease
  • Ingredient analysis is based on AI and third-party data, which may contain errors

You use the App's recommendations at your own risk.

6. Intellectual Property

  • The App, including its design, features, content, and code, is owned by Tovly and protected by intellectual property laws
  • You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes
  • You may not copy, modify, distribute, or create derivative works from the App

7. Third-Party Services and Content

  • Product data is sourced from Open Food Facts and other databases, which may contain inaccuracies
  • AI analysis is provided by third-party services and may not always be accurate
  • We are not responsible for the accuracy, completeness, or reliability of third-party content
  • Links to third-party websites are provided for convenience and do not imply endorsement

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS

9. Indemnification

You agree to indemnify and hold harmless Tovly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Termination

  • You may delete your account at any time through the App settings
  • We may suspend or terminate your access for violation of these Terms
  • Upon termination, your right to use the App ceases immediately
  • Sections that by their nature should survive termination will survive (including Limitation of Liability, Indemnification, and Governing Law)

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tovly regarding the App.
